Under the provisions of the laws of West Virginia, the superintendent may recommend that the board of Education demote, suspend, terminate, or transfer an employee from an administrative or supervisory position. The recommendation shall be supported by evidence of the employee's incompetence or noncompliance with school laws, policy, or regulations, or shall be based on other good and just cause. The recommendation, more over, shall include documentation that the staff provided the employee with professional supervisory assistance and time in an effort to assist the employee to correct the deficiency. The board shall hold a hearing on the recommendation as prescribed by law and afford the employee due process.
